Please help me, I need some advice from you on behalf of a friend?

My friend has joined a consultancy firm recently %26amp; he has been placed with a big client firm %26amp; his job is going on smoothly. Last week his H-1b visa got approved, so he can work in the US for the next 3 years. He is delighted with this news, but he is also facing a little problem here.





He is planning to spend some time with his parents in the coming winter. His parents have a tourist visa to come and visit him in the winter, but they are refusing to come to the US to spend time with him because of his sister's serious health problems. This leaves him with the option of himself going to his home country and visiting his parents %26amp; his sister. But he is paranoid about doing this because some of his friends warned him that the US immigration is very strict when it comes to consultancies %26amp; they may deny his re-entry to the US because his visa is being sponsored by a consultant.





He desperately wants to meet his parents %26amp; vice versa. What approach do you suggest he take in this issue?Please help me, I need some advice from you on behalf of a friend?

He needs to choose which is the more important issue In his life, to go see his family or stay in America and go with it.


He also could contact the American immigration to see what options he has, if any.
Ask this to the people that gave him the visa. I'm sure they can work it out.


Or, he can walk across the border to Mexico, walk back across as an illegal, move his entire family here, and enjoy free benefits.
the immigration centers have what is called advance parole travel [not sure if he would fall into this category BUT would worth him looking it up on the USCIS web site.





Oh and of course you pay for this piece of paper was almost $200.00 and is there for you to be able to travel outside the USA whilst papers are being processed, in certain emergencies it can be done and picked up at the local offices, BUT he must remember if he leaves before things are decided then yes they can deny him re entry and there would be little a lawyer could do for him at that point.

As long as he has valid H-1B status and is still working for the entity that got the visa for him, he will have no problem leaving and re-entering the US.
oh, wow. this is a tough one. it seems hopeless at a first glance, but i'm certain there is a way to figure this out.





the first thing that comes to mind is an immigration lawyer. he could hire one prior to leaving the u.s. to fight for him in case his re-entry is denied. that way he could have some inside help.





secondly, maybe you could help as well. you yourself could be some inside help. also, you are a witness to him being here and situation.





consult an immigration center and ask them for advice just to be sure.

i am pretty sure he can go back for family emergencies. just because US might seem 'stricken' doesn't mean the immigration laws have changed. i can almost guarantee that he can go back for at least 21 days.


he doesn't' have to go to an immigration attorney to resolve this issue....he can get free advice from his consulate....they would be able to tell him if he can go or not and for how long and what permits/transit visa he might need. but its totally doable. also ask him to take his utility bills and a notarized letter from his employer confirming his work status.
He could marry someone.. that's all I know of...
